Terms & Conditions

These Terms & Conditions (the “Terms”) govern your access to and use of cometlore.com, including any purchase made through the Comet Lore online store. Please read them together with our Privacy Policy, Shipping & Delivery information, Returns & Refunds Policy, Payment Policy and any specific promotional terms that apply to your order.

Comet Lore is a trading brand operated by MIRAD Commerce & Operations Michał Radziński, NIP 9731124879, REGON 545887656, with business correspondence address at ul. Marcina Kasprzaka 31/119, 01-234 Warszawa, Poland (“Comet Lore”, “we”, “us” or “our”). We operate an international ecommerce business serving customers in Australia.

1. Acceptance of these Terms

By accessing our website, using our services or placing an order, you agree to these Terms and to the policies expressly incorporated into them. If you do not agree, you should not use the website or place an order.

You must be at least 18 years old to place an order, or otherwise have the permission and involvement of a parent or legal guardian who is authorised to enter into the transaction on your behalf.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or other protection that cannot lawfully be excluded, restricted or modified, including rights that may apply under the Australian Consumer Law.

2. Our online store and international fulfilment model

Comet Lore is managed internationally and is designed for customers in Australia. We work with international suppliers, technology providers, payment providers, fulfilment facilities, postal operators, couriers and other service providers to operate the store and fulfil orders.

Orders are carefully prepared, packed and dispatched from our partner fulfilment facilities in China to customers across Australia. Parcels travel through an international delivery network before final delivery in Australia. The fact that Comet Lore is managed from Europe does not mean that products are manufactured in Europe or dispatched from Europe unless a product page expressly says so.

Orders may occasionally be divided into more than one parcel where this is reasonably required by stock allocation, fulfilment routing or logistics. If we split an order, you will not be charged an additional standard shipping fee solely because we chose to dispatch it in separate parcels.

3. Product information, accuracy and availability

We take reasonable care to present product information accurately and to keep material information current. Product information may include photographs, video, measurements, size guidance, colour names, fabric descriptions, styling information, care information and other details.

Because products are viewed on different screens and may be produced in different manufacturing batches, minor non-material differences can occur. Screen calibration, brightness, lighting, photography and device settings can affect how colours appear. Measurements and fit information may also be subject to ordinary manufacturing tolerances. These points do not give us a right to supply a product that is materially different from the product represented or described.

From time to time, website information may contain a typographical, technical or other inadvertent error. We may correct such information when identified. If an error materially affects an order, we will deal with the affected order in accordance with sections 6 and 8 below and with applicable law.

Availability can change rapidly and adding an item to your cart does not reserve it. If an item becomes unavailable after you order, we may contact you to offer a reasonable alternative where appropriate, but we will not substitute a materially different product without your agreement. If we cannot supply an item that you have paid for, we will provide a refund or another remedy as required by applicable law.

4. Product imagery and digital presentation

To create a consistent ecommerce presentation, some imagery on our website may be digitally produced, retouched, enhanced or composited for presentation purposes. These techniques may be used for elements such as models, backgrounds, lighting, styling or scene composition.

Our intention is to represent the garment and its material features faithfully. Digital presentation is not intended to change the essential construction, colour option, style, included components or material characteristics of the product being offered for sale. Product descriptions, variant selections, sizing information and detail images should be reviewed together before purchasing.

If a product supplied to you is materially different from its description or representation, these Terms do not limit any right or remedy you may have under applicable consumer law.

5. Sizing, fit and measurements

Lingerie and sleepwear can fit differently between styles, fabrics and constructions. A labelled size is not a guarantee that every garment with the same label will fit identically.

Where available, product-specific sizing information should be treated as your primary reference. Our Size Guide, measurements and fit guidance are intended to assist your decision, but individual fit also depends on body proportions, personal comfort preferences and how a particular style is designed to sit on the body.

We cannot guarantee a perfect subjective fit where the product and sizing information supplied are accurate. This does not affect your rights where a product is incorrectly described, incorrectly labelled, faulty or otherwise fails to meet a consumer guarantee that applies by law.

6. Placing an order and electronic communications

When you submit an order, you are offering to purchase the selected products on these Terms, at the price and on the conditions displayed at checkout. An automated order confirmation confirms that we have received your order. It does not necessarily mean that we have finally accepted the order for fulfilment.

An order is accepted when we expressly confirm acceptance, commence fulfilment in a manner that clearly indicates acceptance, or issue a dispatch confirmation, whichever occurs first.

By clicking a button, ticking a box, submitting an order or taking another clear electronic action that indicates agreement, you acknowledge that electronic actions may be used to form or evidence an agreement where permitted by law. You also consent to receiving order confirmations, invoices, notices and other transaction-related communications electronically using the contact details you provide. You are responsible for keeping those details reasonably current.

Before an order is accepted or dispatched, we may reasonably place it on hold, request additional information or cancel it where there is a legitimate reason to do so, including:

  • the product is unexpectedly unavailable;
  • there is a material pricing, description, promotion, inventory or technical error;
  • payment cannot be authorised, verified or completed;
  • the order presents a reasonable fraud, security or unauthorised-payment risk;
  • the delivery address is invalid, incomplete, unserviceable or outside our current delivery area;
  • the order appears to have been created by automated abuse, bots or other misuse of the website;
  • the quantity or ordering pattern reasonably indicates unauthorised resale or other commercial activity inconsistent with a normal retail purchase; or
  • accepting or fulfilling the order would breach a legal, regulatory, payment-provider or sanctions requirement that applies to us.

We will not use this clause to cancel orders arbitrarily. If we cancel a paid order, or a paid part of an order, we will arrange a refund of the affected amount to the original payment method unless another lawful method is agreed with you.

7. Order changes and cancellations requested by you

If you want to change or cancel an order, contact support.au@cometlore.com as soon as possible. We will make reasonable efforts to assist before fulfilment progresses, but we cannot guarantee a change or cancellation once an order has entered processing or has been dispatched.

If a cancellation is not possible because the order has already progressed too far, you may still be able to request a return after delivery in accordance with our Returns & Refunds Policy, subject to its voluntary change-of-mind conditions and your statutory rights.

8. Prices, currency and errors

Unless clearly stated otherwise, prices on the Australian-facing Comet Lore store are displayed and charged in Australian dollars (AUD).

We may change prices, promotions or product availability prospectively at any time before an order is accepted. A change made after you have already formed a contract with us will not retrospectively increase the price of that accepted order.

Despite reasonable care, the website may occasionally contain a clear pricing, discount, shipping, availability, description or technical error. We may correct an error when identified. If the error is identified before acceptance of your order, we may decline or cancel the affected order and, if you have already paid, refund the affected amount.

If a material and obvious error is identified after an order has been accepted, we will contact you and, where permitted by applicable law, give you a reasonable choice to confirm the order on corrected terms or cancel the affected item for a refund. We will not charge an increased price to your payment method without your authorisation.

A displayed crossed-out price, comparison price, promotional price or other pricing representation will only be used where we reasonably believe it can be presented lawfully and accurately. Nothing in these Terms gives us a right to make misleading pricing representations or removes a remedy available under applicable consumer law.

9. Payments and verification

Payment must be made using a payment method available at checkout. Our current payment information is set out in our Payment Policy.

You confirm that you are authorised to use the payment method submitted with your order and that the billing and contact information you provide is accurate.

Payment providers, banks, Shopify and fraud-prevention systems may perform security checks or authentication. Where an order presents a reasonable risk of fraud, unauthorised payment or account misuse, we may temporarily hold fulfilment while reasonable verification is completed. We may cancel an order where the risk cannot be satisfactorily resolved.

If a payment dispute or chargeback is raised, we may provide relevant order records, checkout information, customer communications, tracking, proof of delivery and other appropriate evidence to the payment provider for the purpose of responding to the dispute. Nothing in this clause prevents you from exercising a legitimate right to dispute a transaction or any right available under consumer or payment law.

10. Promotions, discounts and offers

Promotions may be subject to eligibility rules, exclusions, expiry dates, minimum quantities, minimum spend, product restrictions or other conditions communicated with the relevant offer. Specific promotional terms take priority over this general section for that promotion, subject always to applicable law.

Our current multi-buy promotion is explained on the Multi-Buy Offer page. Unless stated otherwise, promotional discounts have no cash value and cannot be exchanged for cash separately from an eligible purchase.

Where a voluntary change-of-mind return is made from a promotional order, an approved refund will reflect the amount actually paid for the returned item or items. If returning part of an order means the products you keep no longer satisfy the conditions for the original promotional tier, the discount may be recalculated in accordance with the published promotion and Returns & Refunds terms, where permitted by law.

Promotional recalculation does not reduce or remove remedies that you are legally entitled to for faulty, damaged, incorrectly supplied or materially not-as-described goods.

11. Shipping and delivery

Our current shipping rates, fulfilment process and delivery estimates are set out on our Shipping & Delivery page and form part of these Terms.

At present, our standard Australian delivery framework includes:

  • Standard Shipping: $8.95 AUD;
  • Free Standard Shipping: orders of $89 AUD or more;
  • usual order preparation: approximately 2–3 business days;
  • usual delivery after dispatch: approximately 4–9 business days; and
  • usual total estimate: approximately 6–12 business days from order placement.

These delivery timeframes are estimates, not guaranteed delivery dates, unless we expressly state otherwise for a specific service or order.

International and domestic delivery may be affected by carrier congestion, public holidays, severe weather, customs or border processing, remote-area service levels, transport disruption or other events outside ordinary delivery schedules. Where we become aware of a material delay affecting your order, we will provide reasonable assistance and information where available.

An estimated timeframe does not give us an unlimited right to delay supply. If we cannot supply your order within a timeframe required by applicable law, we will provide the remedy required in the circumstances.

12. Delivery addresses and failed delivery

You are responsible for providing an accurate and complete delivery address and contact details at checkout. We currently require a valid physical street address and do not ship to PO Boxes.

If you identify an address error after ordering, contact us immediately. We will make reasonable efforts to update the address before fulfilment progresses, but a change cannot be guaranteed once an order is processing or has been dispatched.

If a parcel is returned, redirected, lost or cannot be delivered because the address supplied by you was materially incorrect, incomplete or unserviceable, we may ask you to pay reasonable additional reshipping costs where permitted by law and where the problem was not caused by us or our service providers.

This section does not transfer to you responsibility for a delivery failure caused by us, our fulfilment partners or a carrier where applicable law makes us responsible for providing a remedy.

13. Tracking, delivery confirmation and missing parcels

Tracking information is normally provided after dispatch. Tracking events may take time to appear after a parcel first enters the carrier network.

If tracking shows delivered but you cannot locate the parcel, first check any safe place around the address, with members of your household, building reception or mailroom where applicable, and any delivery information provided by the carrier. If the parcel still cannot be found, contact us promptly so we can review the available information and, where appropriate, raise an enquiry with the delivery provider.

A carrier tracking status is relevant evidence of delivery but does not automatically determine every dispute. We may consider all reasonably available information when investigating a missing-delivery claim.

14. Returns, refunds and exchanges

Our Returns & Refunds Policy explains our voluntary change-of-mind process and the procedure for reporting product problems.

For eligible voluntary change-of-mind returns, we currently allow a return request within 30 days of delivery, subject to the conditions stated in the Returns & Refunds Policy. An approved return must be sent within the timeframe stated in the return instructions.

Voluntary return shipping costs and location: For a voluntary change-of-mind return, the customer is responsible for arranging and paying return postage, including any applicable international shipping charges, which may be higher than domestic postage. Approved voluntary returns are sent to an authorised return address in China or Poland, according to the instructions provided for your order. We will confirm the exact destination address after approving your request and before you send anything back. Do not send a return to our registered business address unless we expressly instruct you to do so.

Voluntary returns are different from statutory remedies for products that are faulty, damaged, incorrectly supplied, materially not as described or otherwise fail to meet a consumer guarantee. Our voluntary-return eligibility rules, hygiene restrictions and return windows do not remove or shorten rights that cannot lawfully be excluded.

Where reasonably necessary, we may assess a product and the information provided about the issue before confirming the appropriate remedy. If applicable law gives you a right to a repair, replacement, refund, compensation or reimbursement of reasonable return costs, we will not use our voluntary-return policy to deny that right.

15. Intimate products and hygiene

Because Comet Lore sells lingerie, underwear, bodysuits and other intimate garments, enhanced hygiene requirements apply to voluntary change-of-mind returns. An item may need to be unworn, unused and unwashed, with original tags attached and any hygiene seal or protective liner fully intact, as described in our Returns & Refunds Policy.

These hygiene conditions do not exclude statutory rights for a product that is faulty, unsafe, incorrectly supplied, materially not as described or otherwise fails to satisfy a consumer guarantee that applies by law.

16. Product care, misuse and normal wear

Please follow care labels and reasonable washing, drying, storage and use instructions supplied with a product. Delicate fabrics such as lace, satin and fine trims may require appropriate care.

To the extent permitted by law, we are not responsible for a product problem to the extent that the problem was caused by misuse, accidental damage after delivery, abnormal or inappropriate use, failure to follow clear care instructions, unauthorised alteration, or ordinary wear and tear rather than a defect or failure that existed in the product.

Nothing in this section affects a consumer guarantee or remedy that applies despite the way a product has been used.

17. Australian Consumer Law

If you are a consumer entitled to protection under the Australian Consumer Law, our goods come with consumer guarantees that cannot be excluded by these Terms.

Depending on the circumstances and the nature of a failure, you may have rights to a repair, replacement, refund, compensation for reasonably foreseeable loss or damage, or another remedy provided by law. The remedy available can depend on whether a failure is major or minor and on the circumstances of the transaction.

Nothing on our website, in our policies, in customer-service communications or in these Terms should be interpreted as requiring you to give up a non-excludable consumer right.

Our voluntary policies may provide rights in addition to your legal rights. They do not replace them.

18. Website access and availability

We aim to keep our website available and functioning, but we do not guarantee uninterrupted, error-free or continuously available access. We may reasonably suspend, restrict or modify parts of the website for maintenance, security, technical improvements, legal compliance or operational reasons.

Temporary website unavailability does not remove rights relating to an order that we have already accepted or obligations that cannot lawfully be excluded.

19. Customer accounts and account security

If customer-account functionality is available and you create or use an account, you are responsible for keeping your login credentials secure and for taking reasonable steps to prevent unauthorised access.

Please notify us promptly if you reasonably believe your account or order information has been accessed or used without authorisation. We may temporarily restrict access where reasonably necessary to protect customers, the store or payment security while an issue is investigated.

20. Acceptable use, account restrictions and website protection

You must not use our website or services to:

  • commit fraud, impersonate another person or make an unauthorised transaction;
  • submit false or materially misleading information;
  • introduce malware, malicious code or other harmful technology;
  • attempt to gain unauthorised access to accounts, systems, data or infrastructure;
  • interfere with website security or normal operation;
  • use automated tools in a way that places an unreasonable load on the website, bypasses technical protections or facilitates abusive purchasing activity;
  • scrape, extract, reproduce or commercially exploit protected website content in breach of applicable law or our intellectual-property rights;
  • collect or misuse personal information belonging to another person without lawful authority; or
  • use the website for any unlawful purpose.

Where reasonably necessary to protect customers, our systems or legitimate business interests, we may restrict access, suspend an account, block abusive automated activity or cancel an affected order where lawful. Any such action will be proportionate to the issue identified and will not remove rights relating to an order already accepted or any right or remedy that cannot lawfully be excluded.

21. Intellectual property

Unless otherwise stated, the Comet Lore name, branding, logos, original website design, copy, graphics, product presentation, photographs and other original content are owned by or licensed to us and are protected by applicable intellectual-property laws.

You may view and use the website for ordinary personal shopping purposes. You may not reproduce, distribute, sell, license, systematically extract, create misleading derivative commercial materials from, or commercially exploit protected Comet Lore content without permission, except where applicable law expressly allows it.

Third-party trademarks, payment marks and other third-party intellectual property remain the property of their respective owners.

22. Reviews, feedback and content you submit

If we provide a feature that lets you submit a review, photograph, feedback or other content, you must have the right to submit that content and it must not be unlawful, defamatory, fraudulent, misleading, abusive, infringing, malicious or in violation of another person's privacy or intellectual-property rights.

You remain responsible for content you submit. By voluntarily submitting content for publication, you grant Comet Lore a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, adapt for technical display, display and use that content for operating, promoting and improving Comet Lore, subject to applicable privacy law and any specific terms communicated when you submit it. You retain ownership of your content.

We may moderate, refuse or remove content for legitimate reasons such as spam, fraud, unlawful material, privacy violations, intellectual-property infringement, malicious code or abuse. We will not use moderation rights to create a misleading impression about genuine customer feedback.

Please do not submit confidential business information or information you do not have permission to disclose through public review or feedback features. Unsolicited ideas, suggestions or proposals sent to us are not treated as confidential unless we expressly agree otherwise in writing.

23. Third-party services, tools and links

Our store relies on third-party services, including Shopify, payment providers, digital wallets, fulfilment providers, carriers, analytics providers and other technology suppliers. Some optional tools or functions made available through the website may also be operated by independent third parties.

Where a third-party service is separately provided to you by that third party, your use of it may be subject to the provider's own terms and privacy information. We do not control an independent provider's website, service availability, security practices or content merely because a link, integration or optional tool is made available through our website.

To the maximum extent permitted by law, we are not responsible for loss caused solely by an independent third party's conduct or service failure where that conduct was outside our reasonable control and the law does not make us responsible for it.

This section does not affect our responsibility for fulfilling an order we have accepted, for representations we make about our own products or services, or for providing a consumer-law remedy where we are legally responsible.

24. Events outside reasonable control

Sometimes performance may be delayed or disrupted by events outside our reasonable control, such as severe weather, natural disasters, major carrier disruption, widespread telecommunications or infrastructure failure, government action, border closures, war, civil unrest, industrial action outside our organisation or other comparable events.

Where such an event materially affects an order, we will take reasonable steps to minimise the effect, communicate where appropriate and resume performance when reasonably possible. This clause does not give us an unlimited right to retain payment without supply and does not exclude remedies that apply by law.

25. Our liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability to the extent that doing so would be unlawful. In particular, where the Australian Consumer Law applies, our goods come with consumer guarantees that cannot be excluded by these Terms.

Subject to the paragraph above and to the maximum extent permitted by law, we are not liable for loss or damage to the extent that it:

  • was not caused by our breach, negligence or other conduct for which we are legally responsible;
  • was not reasonably foreseeable as a consequence of our conduct;
  • was caused or materially increased by your misuse of a product, failure to follow clear care or safety instructions, or unlawful use of the website;
  • was caused solely by materially inaccurate information that you supplied, such as an incorrect delivery address;
  • arose from unauthorised access caused by your failure to keep account credentials reasonably secure; or
  • was caused solely by an event or independent third party outside our reasonable control in circumstances where applicable law does not make us responsible.

Where products are purchased for personal or household use, we do not seek to exclude compensation for reasonably foreseeable loss or damage that you are legally entitled to recover. If you use or resell a product for a business or commercial purpose, any limitation of business-related loss will apply only to the extent permitted by applicable law.

26. Responsibility for unlawful conduct and third-party claims

To the extent permitted by law, you are responsible for direct loss that you reasonably cause to Comet Lore through fraud, deliberate unlawful conduct, malicious interference with our systems, unauthorised use of another person's payment method, or a material breach of these Terms.

If content or conduct for which you are responsible gives rise to a third-party claim against us — for example because content you submitted infringes another person's intellectual-property, privacy or other legal rights — you may be responsible, to the extent permitted by law and to the extent attributable to your conduct, for reasonable direct losses and reasonable external legal costs that we incur in responding to that claim.

This section does not require you to indemnify us regardless of fault, does not make you responsible for loss caused by our own breach, negligence or unlawful conduct, and does not limit any consumer right available to you.

27. Privacy and personal information

Our collection, use, disclosure and protection of personal information is described in our Privacy Policy. By using the website, you acknowledge that information may be processed by service providers needed to operate an international ecommerce store, subject to applicable privacy law.

28. Marketing communications

If you choose to subscribe to marketing, our Newsletter Terms and Privacy Policy explain how marketing communications are managed. You can unsubscribe from marketing emails using the unsubscribe mechanism provided in those messages.

Unsubscribing from marketing does not prevent us from sending necessary non-marketing communications about an order, payment, return, security issue or customer-service request.

29. Changes to these Terms

We may update these Terms from time to time to reflect changes in our services, suppliers, fulfilment arrangements, website features, policies, business structure or legal requirements.

Changes will apply prospectively from the date the updated Terms are published, except where law requires another approach. The terms and policies applicable to an order at the time the contract for that order is formed will continue to govern that transaction to the extent required by law.

We will not rely on a later change to these Terms to retrospectively remove a right or materially alter an accepted order where doing so would be unlawful or unfair.

30. Governing law and mandatory consumer protections

To the extent permitted by law, and except to the extent mandatory consumer law provides otherwise, these Terms and our operation of the store are governed by the laws applicable to our business in Poland.

This governing-law provision does not exclude, restrict or modify the Australian Consumer Law or any other mandatory protection that applies to an Australian consumer. It also does not require an Australian consumer to give up a right to seek a remedy, make a regulatory complaint or commence proceedings in a jurisdiction that applicable law makes available to them.

31. Resolving concerns and disputes

If you have a concern about an order or our service, we encourage you to contact support.au@cometlore.com first so that we can review the issue and try to resolve it efficiently and in good faith.

We may ask for reasonable information needed to identify the order and understand the issue. For product problems, this may include a description and photographs or video of the garment, packaging, label or defect where reasonably necessary. Please do not send intimate images or unnecessary personal information.

Where appropriate, we may suggest an informal resolution period so both sides have a reasonable opportunity to resolve the matter before formal proceedings are started. This is intended as a practical resolution step only and is not a condition that prevents you from exercising a legal right, contacting a consumer-protection authority, using a legitimate payment dispute process or commencing proceedings where applicable law allows.

32. Policies forming part of these Terms

The following pages should be read with these Terms and form part of the conditions applicable to the relevant subject matter:

If a specific promotion, product condition or policy contains a more specific term dealing with the same subject, the more specific term applies to that subject to the extent it is consistent with applicable law. No policy or promotional term overrides a non-excludable consumer right.

33. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down to the minimum extent necessary where legally possible. If it cannot be read down, it will be severed, and the remaining provisions will continue to operate to the extent permitted by law.

34. No waiver

If we do not immediately enforce a right under these Terms, that does not automatically mean we have permanently waived that right. Any waiver must be interpreted consistently with applicable law and does not permit us to revive a right that the law says has been lost or cannot be enforced.

35. Entire agreement and survival

These Terms, together with the policies and specific terms incorporated into them and the information expressly agreed at checkout, constitute the agreement relating to your use of the store and purchase, subject to representations and rights that cannot legally be excluded.

Nothing in this entire-agreement provision excludes liability for misleading or deceptive conduct, false representations, consumer guarantees or other rights and remedies that cannot lawfully be excluded.

Any provision that by its nature is intended to continue after an order is completed, an account is closed or use of the website ends will continue to the extent necessary to give it effect. This includes accrued payment or refund obligations, intellectual-property provisions, licences relating to submitted content, provisions concerning unlawful misuse, limitations that are lawful, dispute provisions, governing law, severability and no-waiver provisions.
